PaceXL: Licence Agreement, Limited Warranty, Disclaimer

The PaceXL software and related documentation, including the Help system, are subject to copyright. Apart from any fair dealings for the purpose of private study, research, criticism or review of the documentation, as permitted under the Copyright Act, no part may be reproduced by any process without the prior written approval of the publisher.

The licence for this product provides a non-exclusive right to use the software, and associated files. Your ownership pertains only to the physical medium on which the software is contained, and not to the software itself or to any copy. All rights to the software contained on the medium remain with the publisher. This licence agreement is not a sale of the original software or any copy to the user.

You may not sell or license copies of the software, or related documentation, to others and may not transfer, lend or distribute the software without the written approval of the publisher.

The PaceXL software is sold AS IS, without warranty. If the CD medium on which the software is delivered is defective, the publisher will replace it within 30 days of date of original purchase. The publisher may be contacted through the organisation that sold the software to you.

To the full extent allowed under the law, these warranties are in place of all other obligations in respect of the operation of the software.

PaceXL has been developed for EDUCATIONAL USE only. The publishers, distributors, licensors and authors give no warranties, either expressed or implied, regarding the software including its correctness, accuracy or reliability nor its merchantability or fitness for any particular purpose and in no event shall they be liable for any damages (including any loss of profits, lost savings or other incidental or consequential damages) in connection with or resulting from the use or performance of any aspect of the software including instructions and documentation accompanying the software. The entire risk as to the results and performance of the software is assumed by you.

The user's only remedy and the publisher's and authors' only obligations pursuant to any warranties implied herein is replacement of the warranted CD medium on which the software is contained.

Some jurisdictions do not allow excluding or limiting implied warranties or limiting liability for incidental or consequential damages; and some jurisdictions have special statutory consumer protection provisions which may override this limitation. As a result, this limitation of liability may not apply to you if prohibited by the laws of your jurisdiction.

The software is licensed for use by a single user. The software is not designed for use on a shared network system. Site licences are available for multiple user installations. Product limitations exist and these are documented in the on-line Help system or in user guide or readme files on the setup disk. The software is Copyright (c) and not to be loaned. Lending the software through libraries or by other means might contravene copyright.

This licence will terminate automatically if the software is used for non-educational purposes or if the user fails to comply with the terms of this licence agreement. Upon termination, the user shall destroy all copies of the software.

Information in the software and all documentation is subject to change without notice. For changes and updates subsequent to publication, please refer to the various "readme.txt" or "readme.doc" files on the setup disk, or refer to this Internet site.

This agreement shall be governed by the laws in force from time to time in the State of Victoria and the parties hereby irrevocably submit to the jurisdiction of the Courts of the State of Victoria, Australia.

By opening the sealed package or by using the software, you acknowledge that you have read and understood these limited warranties and terms and conditions, and agree to be bound by the terms and conditions of the licence agreement. If you do not agree, do not proceed with installation of the software and promptly return the product and original receipt to the place of purchase.

This licence agreement overrides any conflict in meaning should it occur between different documentation relating to this software.
